Terms and Conditions
This Agreement (this “Agreement”) sets forth the terms and conditions of your use of the selected internet services from HN Systems(Adventweb.co.uk/Interserf.com). To become an account holder, you must read and agree to be bound by all terms and conditions of this Agreement, the fee schedules on the Online Order forms and any policies that are or may be published by HN Systems. This Agreement will become effective when accepted by HN Systems. By posting notice 30 days in advance at a web page available on the web site, HN Systems may modify the terms and conditions of this Agreement or the prices of its services, as well as discontinue or change the services offered. You will be bound by the modified Agreement, prices and/or policies if you continue to use the services.
By applying for our services you automatically agree to the following terms and conditions. Please read them carefully before you order.
Whilst we will use reasonable effort to ensure that functions of the service will be error free and uninterrupted, the service is “as is” and there shall be excluded all terms express or implied whether by Law or otherwise except as expressly provided in and so far as it is legal to do so in the context of these terms.
Payment terms for all invoices and services are strictly 14(FOURTEEN) days from date of invoice. Payments are made one month in advance for all services.
Failure to pay after 14 days will lead to immediate termination of service and possible loss of data.
One Month Contract Period unless otherwise stated.
You must inform the Billing Dept. at least 5 days before your billing anniversary if you intend to cancel. Cancellation requests should be sent to billing and a Support Ticket should also be raised. Failure to do so will result in your account being charged for one extra month.
If you are within your first month(30 days), we will refund without question the total amount of your hosting or streaming fees. We regret that money paid for domain names can not be refunded, and will remain active for the duration of the registration period.
Any abuse of our staff in any medium or format will result in the suspension or termination of your services.
The Internet is a powerful information and entertainment tool, we would expect our customers to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users. Our acceptable use policy is actively and strictly enforced. Offending content or users are removed from our network, usually as soon as they are discovered, although we will always inform you before any action has been taken. Common sense is the best guide as to what is considered acceptable use, however the following are unacceptable uses.
In any form, including but not limited to the unauthorised distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material.
Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden. Audio and video downloads may only be hosted if you are the creator and copyright owner of the work.
The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden.
Misuse Of Resources
Including but not limited to employing applications which consume excessive CPU time, memory or storage space. IRC, web proxy and mass mailing scripts are not allowed on our network under any circumstances. Streaming media can be a drain on web server resources and as such is only available on media hosting packages. CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP/ASP message forum.
Domain Name Registration and Renewal Policy
All domain name registrations, transfers and renewals we offer are through eNom.com. We offer domain services through eNom.com only. You agree not to hold HN Systems responsible for any domain name registration, renewal, transfer dispute. We have registered many domains through eNom.com and believe they will make every effort to register, transfer and/or renew your requested domain name. This is not a guarantee that your requested domain name is available for registration, transfer and/or renewal. Your domain name may go unregistered, untransferred and/or renewed, due to circumstances beyond our control, such as registry, software and other problems or outages, and will not be grounds for compensation of financial loss. You are responsible for monitoring your domain expiration date and making sure you renew it before it expires. An order for domain name registration, transfer and/or renewal, does not guarantee domain name registration, transfer and/or renewal.
Limitation of liability
HN Systems shall not be liable for any direct or indirect loss or damages you may incur or suffer arising out of or in connection with your use of the Service ite or a Linked Service which shall include without limitation:
· Delay or inability to use the Service or a Linked Service.
· Reliance upon Third Party Content
· Loss of confidentiality
· Termination of your access
· Virus transmitted
· Failure of communication media
· Unauthorised access to Your computer
· Loss or damage to any data or other information or property
HN Systems treats Your privacy seriously.
Your use of the service signifies your consent to us collecting and using personal information about you in accordance with this Policy of terms and conditions.
Any personal information You provide will only be disclosed with Your express consent.
HN Systems or its affiliated companies may (and only in accordance with any preferences selected by You) use the personal information collected about You to let you know about new goods, services or offers.
HN Systems reserves the right to access and disclose individually identifiable information to comply with Laws or to protect itself or its users.
The laws of England and Wales shall govern these terms.
